Terms & Conditions
These terms explain purchases, original artwork reservations, payments, delivery, cancellations, returns and refunds.

These Terms and Conditions apply to purchases made through the NikolArt website.
Please read them before placing an order. By placing an order, you confirm that you have read and accepted these Terms and Conditions.
1. About NikolArt
The website www.nikol-art.com is operated by:

In these Terms and Conditions, “NikolArt”, “we”, “us” and “our” refer to the person or business identified above.
“You” and “your” refer to the customer placing an order.
These Terms and Conditions are intended primarily for customers purchasing as consumers rather than wholly or mainly for business purposes.
2. Our products
NikolArt sells:
unique original artworks;
fine art prints;
other art-related products that may be listed on the website from time to time.
Each original artwork is unique and has a maximum available quantity of one.
Unless the product description states otherwise, fine art prints are:
open edition;
supplied unframed;
printed on fine art paper;
shipped rolled in a protective tube.
The individual product page forms part of the product description and will state the applicable:
title and medium;
dimensions and shape;
price;
original availability;
print sizes and prices;
delivery options;
production or dispatch estimate;
collection or international-delivery restrictions.
3. Original artworks
An original artwork may be shown as:
Available;
Reserved;
Sold;
Not for sale.
Adding an original artwork to a basket does not permanently reserve it.
The website may place a temporary reservation on an original while checkout is being completed. The original is not secured until payment has been completed and the order has been accepted.
Because an original is unique, a technical or simultaneous-order conflict may occasionally occur. If more than one customer attempts to purchase the same original, the first successfully verified and accepted order will take priority.
If we receive payment but cannot supply the original, we will cancel the affected order and issue a full refund.
When an original is sold, it may remain visible in the Sold section. Fine art prints of the same artwork may continue to be available.
4. Fine art prints
Print sizes, prices, paper details and production estimates are shown on the relevant artwork page.
A standard open-edition print in one of the sizes listed on the website is not treated by NikolArt as a bespoke item solely because it is produced after the order is placed.
Minor variations may occur between separate print runs, but the print must remain consistent with the product description and displayed artwork.
Prints are supplied without a frame unless the product description expressly states otherwise.
5. Product images and appearance
We take reasonable care to display artworks and prints accurately.
However:
screen settings vary between devices;
brightness and colour calibration can affect appearance;
photographs cannot always reproduce the exact colour, texture, surface or scale of a physical artwork;
natural texture, brush marks, surface variation and handmade characteristics may form part of an original artwork.
Product images are therefore illustrative, but the product supplied must still correspond materially with its description.
Dimensions are stated as accurately as reasonably possible. Customers should review the listed measurements before ordering.
Nothing in this section limits your rights where a product is faulty, materially different from its description or otherwise does not comply with applicable consumer law.
6. Placing an order
To place an order, you must:
be at least 18 years old;
provide complete and accurate order information;
have authority to use the selected payment method;
provide a valid delivery address where delivery is requested.
Before completing checkout, you will have an opportunity to review the products, quantities, delivery option and total price.
An automated acknowledgement that we have received your order does not necessarily mean that the order has been accepted.
A binding contract is formed when:
payment has been successfully completed; and
we send an email confirming that the order has been accepted.
We may decline an order before acceptance where there is a reasonable reason to do so, including:
the product is unavailable;
payment has not been authorised;
we cannot deliver to the requested destination;
the order information is incomplete or appears fraudulent;
there is an obvious pricing or product-description error;
fulfilling the order would be unlawful.
If payment has already been taken for an order we cannot accept, it will be refunded.
Once an order has been accepted, we will not increase the agreed product price.
Online sellers must make the payment obligation, total price, delivery costs, ordering steps and correction of order errors clear before the customer submits the order.
7. Prices
Prices are displayed in pounds sterling unless another currency is expressly shown.
Product prices include any UK taxes that NikolArt is legally required to charge.
Delivery charges are not included in the product price unless expressly stated. The applicable delivery cost or method of calculating it will be shown before the order is completed.
Prices may change at any time, but a change will not affect an order that has already been accepted.
If an obvious pricing error is identified before an order is accepted, we may reject the order and notify you.
8. Payment
Payments are processed using Stripe Checkout and the payment methods displayed during checkout.
When hosted Stripe Checkout is used, the customer enters payment details on a payment page operated by Stripe. NikolArt does not receive or store the customer’s complete card number or card security code.
We may receive limited transaction information, including:
payment status;
transaction reference;
payment method type;
billing details;
limited card information supplied by Stripe, such as the last four digits.
An order will not be dispatched until the required payment has been completed.
9. Delivery of original artworks
Each original artwork is packed separately in protective packaging.
The artwork page may specify one of the following delivery arrangements:
fixed-price UK delivery;
fixed-price UK and international delivery;
insured delivery subject to an individual quotation;
collection only;
delivery currently unavailable.
Where an insured delivery quotation is required, the order is not final until:
the delivery quotation has been provided;
you have accepted it; and
the full agreed payment has been completed.
Some original artworks may not be available for international delivery.
The delivery option shown on the individual artwork page takes priority over general delivery information elsewhere on the website.
10. Delivery of prints
Prints are shipped rolled in protective tubes.
Up to five eligible prints may be packed together in one combined tube.
Where available, you may choose separate packaging, including one print per tube. Additional delivery charges may apply for additional tubes and will be shown before payment.
Original artworks and print tubes are treated as separate packages and may have separate delivery charges or arrive separately.
11. Delivery times
Production and dispatch estimates are shown on the website or in the order confirmation.
Unless a different delivery period has been agreed with you, goods will normally be delivered within 30 days after the contract is formed.
Delivery dates are estimates unless expressly agreed as guaranteed.
We are not responsible for a delay caused by an event outside our reasonable control, but we will contact you where a material delay becomes known and take reasonable steps to minimise it.
If a substantial delay occurs and the law gives you the right to cancel, you may cancel the affected order and receive a refund for products that have not been supplied.
12. Delivery address
You are responsible for providing a complete and accurate delivery address.
Please contact us as soon as possible if you discover an error. We cannot guarantee that an address can be changed once the parcel has been dispatched.
Where a delivery fails because the address supplied was materially incorrect or incomplete, we may ask you to pay the reasonable direct cost of arranging another delivery, where permitted by law.
We will not impose an arbitrary administration or restocking charge.
13. International orders
International delivery is available only where stated on the product page or agreed in writing.
Orders sent outside the United Kingdom may be subject to:
import VAT;
customs duties;
clearance charges;
local taxes or handling fees.
Unless the checkout or delivery quotation expressly states that these charges are included, they are the customer’s responsibility.
International customers are responsible for checking their local import requirements before ordering.
Local mandatory consumer rights may also apply and are not excluded by these Terms and Conditions.
14. Collection
Where an artwork is offered on a collection-only basis, collection must be arranged in advance.
The person collecting may be asked to provide:
the order confirmation;
suitable identification;
written authority where collecting for another person.
Responsibility for the product passes to you when the product is collected by you or by a person authorised by you.
You should inspect the outer packaging and the artwork at the time of collection where reasonably possible.
15. Responsibility for goods during delivery
We remain responsible for the goods until they are delivered to:
you;
a person identified by you to receive them; or
a safe location expressly authorised by you, where applicable.
If you independently arrange a carrier that was not offered by NikolArt, responsibility may pass when the goods are handed to that carrier, as permitted by applicable law.
16. Your right to cancel an online order
Where the statutory cancellation right applies, you may cancel an online order without giving a reason.
For goods, the cancellation period normally ends 14 days after the day on which you, or a person nominated by you, receives the goods.
Where one order contains goods delivered on different days, the period normally begins after the final item is received.

You may use the model cancellation form at the end of these Terms and Conditions, but you are not required to use it.
After notifying us, you must normally return the goods within a further 14 days.
You do not need to give a reason for cancelling.
17. Cancellation before dispatch
You may contact us to request cancellation before dispatch.
Where the order has not yet been dispatched and no statutory exception applies, we will normally cancel it and refund the amount paid.
If the parcel has already been dispatched, you may need to receive and return it under the returns procedure.
18. Bespoke and personalised products
The ordinary change-of-mind cancellation right may not apply to goods that are:
made to your individual specification;
clearly personalised;
created as a bespoke commission specifically for you.
A standard print selected from the sizes and options ordinarily listed on the website is not considered personalised merely because it is printed after purchase.
Any bespoke commission will normally be governed by a separate written quotation or commission agreement explaining:
the agreed specification;
price and deposit;
expected timescale;
revision arrangements;
when production begins;
applicable cancellation terms.
The bespoke exception does not remove your legal rights where a product is faulty, misdescribed or does not conform to the agreed specification.
19. Returning an unwanted product
Please contact cs@nikol-art.com before returning a product so that we can provide the correct returns address and practical packaging instructions.
Unless the product is faulty, damaged before delivery or misdescribed:
you are responsible for the direct cost of returning it;
you remain responsible for taking reasonable care of it until it is received by us;
we strongly recommend using an appropriately tracked and insured delivery service.
Original artworks may require a specialist or insured courier. Where an original cannot normally be returned by ordinary post, the product page, checkout or pre-contract delivery information should state an estimate of the likely return cost.
Please reuse the original protective packaging wherever reasonably possible. If it is no longer available, the product must be packed to an equivalent protective standard.
Failure to use the original packaging does not automatically remove your cancellation rights. However, you may be responsible for a reduction in value caused by unnecessary handling or inadequate return packaging.
20. Condition of returned products
You may inspect a product to the extent reasonably necessary to establish its nature and characteristics, in a similar way to inspecting it in a physical shop.
You are responsible for taking reasonable care of the product.
Where handling goes beyond what is reasonably necessary and reduces the product’s value, we may make a reasonable deduction from the refund that reflects the actual reduction in value.
We will not impose a fixed restocking fee.
21. Refunds following cancellation
Where a valid cancellation right is exercised, we will refund:
the price paid for the returned product;
the cost of the least expensive standard delivery option offered for the order.
If you selected a more expensive delivery service, we are not required to refund the difference between that service and the standard delivery option.
The refund will normally be made using the original payment method.
We may wait until:
we receive the returned goods; or
you provide evidence that they have been sent back,
whichever occurs first.
The refund will normally be issued within 14 days after that point.
22. Faulty, damaged or misdescribed products
Products must be:
of satisfactory quality;
fit for their normal purpose;
consistent with their description.
Please contact us as soon as reasonably possible if a product:
arrives damaged;
is faulty;
is materially different from its description;
is incomplete;
is not the product ordered.
Please provide:
the order number;
a description of the problem;
photographs of the product and packaging where reasonably possible.
Photographs and packaging information help us investigate courier damage, but your legal rights do not depend on filming the unpacking process.
Where the product is faulty, damaged before delivery or misdescribed, NikolArt will be responsible for the reasonable return cost and will provide the remedy required by applicable consumer law.
Depending on the circumstances, this may include:
rejection and refund;
repair;
replacement;
price reduction.
Nothing in these Terms and Conditions restricts your statutory consumer rights. Customers must be offered appropriate remedies where goods are faulty, not as described or do not perform as they should.
23. Delivery damage
Visible damage should, where reasonably possible, be noted when accepting the parcel.
Please retain the packaging and contact us promptly. This allows us to investigate the matter with the courier and arrange an appropriate solution.
A failure to mark the parcel as damaged, report it within 48 hours or provide an unpacking video does not automatically remove your statutory rights.
24. Caring for artworks and prints
Artworks and fine art prints should be handled carefully.
Unless the product description states otherwise:
avoid prolonged direct sunlight;
avoid excessive moisture, humidity and rapid temperature changes;
do not expose the artwork or print to water, sprays, detergents or solvents;
handle paper prints with clean, dry hands;
do not place pressure against the back of a stretched canvas;
seek professional assistance where appropriate when mounting, framing or hanging an artwork.
Damage caused after delivery by improper handling, unsuitable storage, incorrect hanging, accidental damage or inappropriate cleaning is not treated as an original product fault.
This does not affect responsibility for a defect that was present when the product was delivered.
25. Hanging and installation
You are responsible for choosing an appropriate method of mounting or hanging the product for the relevant wall, surface and environment.
NikolArt does not provide structural, installation or building advice unless expressly agreed in writing.
We are not responsible for damage caused by:
unsuitable fixtures;
incorrect installation;
failure to consider the weight of the product;
an unsuitable wall or surface;
installation carried out without reasonable care.
Nothing in this section excludes liability where loss is caused by our own negligence or breach of legal duty.
26. Ownership and copyright
Ownership of the physical product passes to you once:
full payment has been received; and
the product has been delivered or collected.
Buying an original artwork or print does not transfer the copyright or other intellectual property rights in the image.
Unless expressly agreed in writing, you may not:
reproduce the artwork commercially;
create or sell copies;
use the image on merchandise;
license the image to another person;
use website images for advertising or commercial publication;
alter and distribute NikolArt images as your own work.
Reasonable private photographs of a purchased artwork for personal use are permitted.
27. Website content
The artwork images, text, branding, graphics and other original material on this website are owned by or licensed to NikolArt.
They may not be copied, republished, sold or commercially exploited without prior written permission, except where use is permitted by law.
28. Cancellation by NikolArt
We may cancel an order where:
the product is unavailable;
payment fails or is reversed;
we reasonably suspect fraud or unlawful activity;
delivery to the destination is not reasonably or lawfully possible;
an obvious pricing error is identified before acceptance;
an event outside our reasonable control makes performance impossible.
Where you are not responsible for the cancellation, we will refund payments received for the cancelled part of the order.
29. Events outside our reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, such as:
severe weather;
fire or flood;
transport or courier disruption;
industrial action;
interruption of telecommunications or hosting services;
government restrictions;
war, civil disorder or terrorism;
public-health emergencies;
failure of essential suppliers despite reasonable precautions.
We will contact you where possible and take reasonable steps to reduce the effect of the event.
If the event prevents fulfilment for a significant period, either party may be entitled to end the affected contract. Products not supplied will be refunded.
30. Our responsibility to you
Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of statutory consumer rights;
faulty or misdescribed goods;
any other liability that cannot legally be excluded.
We are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care.
We are not responsible for loss that was not reasonably foreseeable when the contract was formed.
These consumer Terms and Conditions do not cover commercial or business losses, including loss of profit, revenue, business opportunity or business interruption.
Terms that remove statutory rights, allow arbitrary changes or impose disproportionate cancellation charges may be unfair and unenforceable.
31. Personal information
Personal information is processed in accordance with the NikolArt Privacy Notice.
NikolArt does not use contact-form or order information to subscribe customers automatically to promotional or marketing communications.
Information may be shared only where reasonably necessary to process payment, deliver an order, comply with law or operate and protect the website.
32. Electronic communications
Order acknowledgements, order confirmations, invoices, dispatch notifications and other contractual information may be provided by email.
You are responsible for providing a valid email address and checking your spam or junk folder.
Contractual information will be provided in a form that can be retained by you, such as an email. Online sellers must provide confirmation and a copy of the contract in a format the customer can save.
33. Complaints

supporting photographs or documents where relevant.
We will acknowledge and investigate complaints within a reasonable period.
Nothing in this section prevents you from exercising your statutory rights or seeking an independent legal remedy.
34. Changes to these Terms and Conditions
We may update these Terms and Conditions from time to time.
Changes will apply to future orders and will not normally alter a contract already formed.
The Terms and Conditions applicable to your order are those made available to you when the order was placed, subject to any change required by law.
35. Severability
If any part of these Terms and Conditions is found to be unlawful or unenforceable, that part will be treated as removed to the minimum extent necessary.
The remaining provisions will continue to apply.
36. No waiver
If either party delays enforcing a right, that does not mean the right has been waived.
A waiver applies only where it is clearly given and only to the specific circumstances for which it was given.
37. Governing law and courts
These Terms and Conditions and contracts made under them are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or another country, you may also benefit from mandatory protections provided by the law of your place of residence.
Nothing in these Terms and Conditions removes any right you may have to bring proceedings in a court that has jurisdiction under applicable consumer law.
